L.A.: D.A. Says Most Medical Marijuana Outlets Illegal, Prepares Crackdown

Medical-marijuana outlets that sell the drug over the counter in Los Angeles will be prosecuted criminally, according to county district attorney Steve Cooley.

The Los Angeles Times reported Oct. 9 that Cooley contends that the majority of medical-marijuana dispensaries in the county are operating in violation of state law, which stipulates that collectives can only charge enough to cover their own costs, not rake in profits. There currently are up to 800 medical-marijuana dispensaries in Los Angeles, many operating without permission.

"The vast, vast, vast majority, about 100 percent, of dispensaries in Los Angeles County and the city are operating illegally, they are dealing marijuana illegally, according to our theory," Cooley said. "The time is right to deal with this problem."

However, Joe Elford, a lawyer for Americans for Safe Access, said that Cooley is misinterpreting the law. "I'm confident that they are not right," said Elford. "If they are right, it would mean that thousands of seriously ill Californians for whom the Compassionate Use Act was intended to help would not be able to get the medicine that they need."

Don Duncan, California director of Americans for Safe Access, agreed that many dispensaries are in violation of the law and urged Cooley to focus on those programs. "You don't have to cast a net over the entire community, you can target the problem people and not take this extreme adversarial position," he said.

Drug policy expert Mark Kleiman of UCLA termed Cooley's proposed crackdown "a natural response to the rather flagrant marketing practices of a bunch of the dispensaries. The medical veneer has been wearing thinner and thinner. I've always wondered why those things were legal when they didn't look legal to me."

In California, the very idea of, marijuana,is illegal. no one in the government really want's anything to do with this product, except for a large part of the people.so just like recently Schwarzenegger, signed a new bill, concerning gay right's and giving Harvey Milk a legal holiday,this goes against the will of the majority of the voter's that put down prop 8, and gay marriage, even though his biased, persona, was seen in his film, pumping, iron ,happily enjoying some good, marijuana.and admitting it.anyone can see this simply by going on-line and typing in the word's gov smoke weed and clicking on his video.there are after all a few (special people) that like to laugh, in people's face's.my view is that , if something's good for one it's good for all,or else there's no such thing as (equality) period.sick or not sick.every single one of us is on the same road to a casket(wether we like it or not). I sincerely hope that one day that the people we elect to represent us, will keep the word's that they say to us, that got us to vote for them in the first place ,instead of come up with new agenda'a and , tax'es for us to pay, and bailout's for the super rich,that squandered their money and got to use our's, to get back to the top! Six hundred of these illegal business have been taken over by the Mexican Mafia. This is information from dipensary owners who have fled LA and tried to start up in San Diego only to find out we enforce California Law and will soon be shuting down their stores. Accordintg ASA we must have an epidemic of sick people in California we should have the CDC look into how sick Californians are.

The wide-ranging mild and beneficent medicinal effects of cannabis, it's virtual lack of deleterious side-effects, and new delivery systems which include ingestion and vaporization beg the question: why are we forcing people to take expensive allopathic drugs with terrible track records which include liver damage and severe addiction? Less than a century ago, most physicians in the United States were using cannabis for multiple ailments, including as an aid to eliminating addiction to opiates and alcohol. Do we really believe they had it all wrong?

Steve the Plumber: Your comment was so incoherent that it made we wonder if you were actually on pot when you wrote it. If you would not like to give that impression, you might try writing in full sentences, using capital letters at the beginning of your sentences, and using correct punctuation. You do your "cause" a disservice by appearing to be stoned (or uneducated).
