Federal Appeals Court Upholds Conviction of Marijuana Advocate

A federal appeals court has upheld the conviction of prominent medical-marijuana advocate Ed Rosenthal for growing the drug, the San Francisco Chronicle reported June 12.

Rosenthal was convicted of growing marijuana for a San Francisco dispensary in 2003, then retried and convicted again in 2007 after an appeals court overturned the initial conviction.

Evidence indicating that Rosenthal grew the drug for medical marijuana patients to use legally under California law was excluded from the trial. In the 2007 retrial, U.S. District Judge Charles Breyer sentenced Rosenthal to the one day in jail he had already served, instead of the five-year jail sentence usually required by federal law.

Rosenthal appealed his felony conviction, but the Ninth U.S. Circuit Court of Appeals in San Francisco said that information about Rosenthal's intent in growing the drug was irrelevant under federal law.

Another convicted felon. Wow, only one day in jail. Maybe being a dirtbag is not that bad a gig. You know he is still growing pot with no punishment. Oh well California deserves the mess they are in. Good luck Ed.

To Verde and his Federalist Buds: Get a job! How dare you call Ed Rosenthal a Dirt Bag..he is a SAINT that stands in the top 20 advocates for the advancement of medical marijuana in the United States. I think that he should be exonerated and paid a huge amount of money for every day he lives as a Felon. How does it feel to be in the minority these days..don't like it do you? Well get used to it because people are waking up to the facts every single day., that Medical Marijuana is here to stay. Shed those antiquated attitudes and join the movement to legalize or get out of the way.

THINK how much money Rosenthal had to invest in lawyering to keep the appeals going, etc. otherwise 5 years hard time in the punishment proliferation penetentiary getting gangraped and all the other "extrajudiciary" stuff. Not long ago I was arrested and charged with cannabis possession. Within a week I got letters from 2 lawyer firms assuring me I was in enough danger to acquire their assistance starting at $75. I went to court and it was dismissed,l but what if I had been a naive youngster from a naive family-- I would have paid the $75, and then when it was dismissed not have known the $75 was unnecessary. That's how the cannabis prosecution system works and who has a stake in perpetuating it.
