Cloves, Other Flavored Cigarettes About to Disappear from Store Shelves

U.S. smokers who want flavored cigarettes have only a couple of days to stock up: the Food and Drug Administration (FDA) is ordering cloves and other flavored cigarettes pulled from the marketplace by Sept. 22 as it enforces the provisions of the Family Smoking Prevention and Tobacco Control Act.

The Woodland (Calif.) Daily Democrat reported Sept. 16 that the swiftness of the ban has taken some retailers and customers by surprise. Federal lawmakers sought the prohibition on flavors like cherry, grape, chocolate, and cloves (but not menthol) by citing their appeal to children.

The FDA notified tobacco sellers this week that "manufacturers, distributors, and retailers may be subject to injunction actions, civil money penalties, and/or criminal prosecution for violating the requirements of the Act."

About $140 million worth of clove cigarettes had been sold in the U.S. annually. Kretek International, a clove cigarette maker, is seeking to dodge the ban by manufacturing flavored cigars that are roughly the size of a cigarette.

Despite all the hyped up claims that the new FDA law's flavored cigarette ban (except menthol) was needed to protect youth, this provision impacts fewer than .02% of cigarettes sold in the US, and will have no impact on youth smoking. Most clove cigarettes in the US are smoked by immigrants from Indonesia (where clove cigarettes account for most of the cigarette market), and very few minors smoke clove cigarettes. Nearly all of the other flavored cigarettes that are banned by the new FDA law were removed from the US market several years ago after Reynolds agreed to do so in a settlement with State AGs.

The withdrawal of these cigarettes I view as a violation of my constitutional rights. I am sick of legislation that restricts my rights as a US citizen. If I did a study and could convince everyone that nail polish was a cancer link do you think it would cause the reaction that smoking does? Warning labels on bottles, jail sentences for parents who let their kids wear nail polish. I started smoking when I was 45. I enjoy it and am not going to quit. If I have to grow tobacco in my basemant, I will.

If you own a vaporizer, presumably you can place in it simultaneously a little bit of tobacco (maybe torn off a cigarette or cigar) and a little bit of some other herb or root or fruit etc. Also various flavor combinations are available in e-cigarettes. So it is not true that such regulations really interfere importantly with anyone's liberties.

Finally, some regulation of cigarettes. It's not perfect, but it's the beginning. Good change takes a long time. Hope we can reach the real tipping point and put the bums out of business.

Susan, the constitution has no amendment guaranteeing smokers rights just as it does not guarantee anyone's right to drive. These are privileges that can be enjoyed provided that they do not infringe on anyone else's pursuit of life liberty and the pursuit of happiness. Smoking in someone else's airspace jeopardizes their health, driving under the influence can kill or injure innocent people. So legislation is necessary to safeguard the health and welfare of those who could suffer from the unintended consequences of these privileges
