Utah Senate Bans Smoking in Car with Kids; House Action Uncertain

A bill that would ban smoking in cars with children under age 5 and slap offenders with a $45 fine has been approved by the Utah Senate, but faces a "battle" in the state House, the Salt Lake Tribune reported Jan. 29.

The bill has support from the American Cancer Society, but some lawmakers cast it as unwarranted government intrusion. "If I vote for this measure, in the spirit of incrementalism, next year are we going to have a bill filed to fine parents who don't have the right filter in their furnace for their asthmatic child?" asked Sen. Howard Stephenson (R-Draper).

Sen. Scott Greiner, who also serves as the chief of the Ogden Police Department, asked how police are supposed to determine the age of a child in a car. But supporters of the measure said that no police agencies have raised objections against the bill.

The Utah Senate passed a similar measure last year, but it died in the House.

Smoking in a vehicle with a child is selfish and it infringes upon the rights of the minor who is forced to inhale toxic fumes while unaware of the extreme negative consequences which they will have to face latter in life. I find it difficult to comprehend that lawmakers have not yet made smoking in a car with a minor illegal. A minor is anyone under the age of 18. It is apparent that our government officials are oblivious to negative health effects caused by cigarette smoke and need to be enlightened by knowing that 438,000 premature deaths are caused in the United States because of cigarette smoking. If in fact our lawmakers are aware of such an atrocity they are not doing their job. By not making smoking illegal in the presence of a minor American politicians are knowingly letting the innocent become victims of their negligence and stupidity. Such a topic is not debatable in an intelligent group of individuals. I am optimistic that one day common sense will prevail and that our children will not be punished for our negligence in protecting them.
