Federal Court Says Dying Woman Can Be Prosecuted for Medical Marijuana Use

The 9th U.S. Circuit Court of Appeals has ruled that a dying woman who uses medical marijuana can be prosecuted under federal drug laws, the Associated Press reported March 14.

Angel Raich's doctor says marijuana is the only thing keeping the Oakland mother of two alive: Raich, 41, suffers from scoliosis, a brain tumor, and chronic nausea. She uses marijuana to fight her pain and stimulate her appetite.

Two years ago, the U.S. Supreme Court ruled against Raich in a pivotal medical-marijuana case, saying that California's medical-marijuana law does not protect medical users and suppliers from federal drug prosecution. In the latest case, the appeals court said that there is no exception for cases where a doctor says that marijuana is the only option for keeping a patient alive.

Raich said she would continue to use the drug regardless of the court's decision.

I stand behind you 100% Angel Raich.The U.S, government has gone to far,in trying to "illegally"gain access to our records.I have no faith in a legal system that has been destroyed by the busch administration.it's ok for them to circumvent our laws,but at the same time they hide behind certain laws!I say bulgadash..All of them should be arrested for there crimes against the american people.

I find this whole thing very sad! Narcotics can be prescribed that have terrible, lasting side effects but a dying woman is denied access to something that will make her comfortable and able to enjoy her two children a little better? People using marijuana for medical purposes are not as likely to become addicts as those using vicadin. Why are we so afraid of something so comparatively harmless? Is it because it didn't come from the drug companies? Or maybe it isn't fear at all but power? Just so sad!

I am extremely disappointed that the U.S. Supreme Court would press charges against Angel. Her doctor has prescribed her with medicinal marijuana in order to keep her alive. It's not as if she is harming anyone by using the marijuana, and its not as if she is selling it. She is using the medicinal marjuana for the primary purpose of relieving her chronic pain. Instead of wasting time on cases like this the government should reconsider their priorities. How about focusing their time on treatment programs for drug addicts? Drug addiction is complicated disease.The government needs to put more funding into treatment because it is cheaper to do that than to pay for them in jail in the long run.

It's time we stand up against the federal courts they like to see people in pain and suffering!!We need to put a stop to them!!They need to know who pays their salaries

Pot is against the law there is no excuse to use it.This lady in serious pain can get a perscription from a better doctor to ease her suffering.She needs to see another doctor because the one she has is very wrong.She says she is going to continue to use pot and not do what the law says so she is breaking the law and they have a right to come after her again.Im sorry she is in great pain but there is legal medicine that can help her.

I sure hope this woman is OKAY and doing well? What the heck is WRONG with them? They are trying to take something from her that is helping her! Oh, I know they rather her take oxycoton or vicadin so the Pharmaceutical Companies can continue THEIR drug dealing!

Hey, if smoking weed is the only thing keeping her alive, why has she lived for two years in federal prison? I'm sure she knew the consequences of her actions, so let her enjoy the punishment she deserves. I don't think it made her pain go away, marijuana only made it worse. Don't blame the law, blame the violator.
