Murder Charges Stand Against Meth-Using Mom August 16, 2006
News Summary
A California women who used methamphetamine and then breast-fed her child, who later died, is still facing murder charges after a judge ruled that "it was abundantly clear to the court that the cause of death was due to (methamphetamine intoxication)," the San Diego Union-Tribune reported Aug. 14.
Riverside County Superior Court Judge Patrick F. Magers refused to dismiss second-degree murder charges against Amy Leanne Prien, who already has been tried twice. The Riverside County District Attorney has not decided whether to take the case to trial for a third time.
Prien was found guilty of second-degree murder and child endangerment in 2003 and sentenced to 15 years to life in prison, but the conviction was thrown out because of bad jury instructions by the judge. Earlier this year, a second trial ended with a hung jury.
