The U.S. Supreme Court rejected an appeal brought by a South Carolina hospital that provided the results of drug tests on pregnant women to police, the Associated Press reported June 17.

Two years ago, the Supreme Court said the policy at the Medical University of South Carolina in Charleston violated the Fourth Amendment, which protects against unreasonable searches and seizures.

Under the 1989 policy, the hospital screened the urine of pregnant women for drugs. Those testing positive were arrested as soon as they gave birth.

The case now heads back to the federal district court in Charleston, where a jury will determine damages in the lawsuit.
