Court Rejects DEA Ban on Hemp Food

The Ninth U.S. Circuit Court of Appeals in San Francisco, Calif., ruled that the Drug Enforcement Administration's (DEA's) ban on food products containing hemp is illegal, the San Francisco Chronicle reported July 1.

The appeals court said that the DEA failed to give proper public notice before announcing the ban.

Prior to the ruling, the DEA issued a similar ban in separate regulations that were distributed to the public before the April effective date. But because the hemp industry sued a second time, the court blocked the ban until a ruling in the second lawsuit is made.

Previously, hemp seeds and oil were excluded from the definition of marijuana in U.S. drug laws. But the DEA said that the trace amount of THC, the active ingredient in marijuana, found in hemp food products makes them unsafe for consumption. The ban does not affect products like clothing and paper.
