N.Y. Police Officer Charged in DUI Deaths

A New York City police officer, who was driving drunk, was charged with second-degree manslaughter in the death of a baby who was delivered after the mother died in the crash, the Associated Press reported Sept. 4.

According to authorities, Joseph Gray, 41, a 15-year veteran of the police force, was on an all-day drinking binge. The crash occurred on his way to work.

Killed in the crash were Maria Herrera, 24, who was eight months pregnant; her 4-year-old son, Andy Herrera; and her 16-year-old sister, Dilcia Pena.

Gray was charged with second-degree manslaughter because investigators determined that the baby had a heartbeat for 12 hours after the Caesarean section delivery.

"We believe that it was more than enough evidence to prosecute the death of a live baby," said Brooklyn District Attorney Charles Hynes.

Gray has pleaded innocent to other offenses, including manslaughter, related to the Aug. 4 crash. Gray resigned from the New York Police Department last week.
