Texas Sues Online Tobacco Merchant

The attorney general of Texas filed a lawsuit against an online tobacco merchant for failing to take measures to prevent sales to minors, UPI reported Dec. 27.

Citing the state's Deceptive Trade Practices and Consumer Protection Act, Attorney General John Cornyn requested an injunction against the Virginia-based E-Commerce Today Ltd.

Under Texas law, it is illegal to sell tobacco products to anyone under age 18. The lawsuit against E-Commerce Today states that the company incorrectly claimed that it maintains a system to prevent sales of tobacco to minors.

In addition, the lawsuit claims that E-Commerce Today failed to verify that online buyers were at least 18, and allowed the delivery of tobacco products without making certain that an adult over the age of 18 signed for the purchase.

Cornyn said that those who fail to protect children from tobacco marketing "are threatening the health of our young people for profit, and the state of Texas will not tolerate that. These businesses should play by the same rules as bricks-and-mortar retailers in verifying ages of buyers."
