Judge Upholds Damage Award in Fla. Smokers Case

The record-setting $145 billion damage award to Florida smokers has been upheld by a Florida judge, despite appeals from the tobacco industry to reduce the amount and conduct a new trial, the Associated Press reported Nov. 6.

Circuit Judge Robert Kaye issued the order on the same day he learned that a federal judge rejected a request by the tobacco industry to appeal the verdict in federal, rather than state court.

The tobacco industry plans to file a notice of appeal on the jurisdiction issue, as well as on the verdict ruling.
