Appeals Court Rejects Class-Action Lawsuit

A New York appeals court rejected a bid for a class-action lawsuit brought by a group of smokers seeking damages for illnesses caused by smoking, Reuters reported Dec. 1.

In unanimously rejecting the lawsuit, the court ruled that the cases had to be considered individually.

"We're very pleased with this decision because it underscores why the class-action device cannot fairly resolve these kinds of claims," said William S. Ohlemeyer, associate general counsel for Philip Morris Cos. Inc., the world's largest cigarette maker.
